Licensing on a Forecourt
The Licensing Act 2003 states that “premises used primarily as a garage or which form part of premises which are so used” are excluded from the sale by retail or supply of alcohol.The Guidance to Local Authorities explains the case law by which a licensing authority can grant an alcohol licence to a store that trades on a forecourt. The key is being able to prove that your store is not used primarily as a garage, this is most usually done by measuring customer usage of the store. EPOS data can be used to show that your store does a significant proportion of non-fuel business in terms of transactions.
